1. What ProspectPull provides
ProspectPull provides lead intake, organization, follow-up, review-request, and related automation setup for home-service businesses. Services may include missed-call text-back, website or chat intake, owner notifications, setup support, reporting, after-hours intake, and follow-up workflows depending on the selected package and approved setup.
2. No guaranteed results or emergency service
ProspectPull does not guarantee booked jobs, revenue, customer conversion, response times, emergency dispatch, technician availability, prices, arrival windows, or business results. ProspectPull is not an emergency response service. Clients remain responsible for reviewing leads, contacting customers, confirming appointments, providing services, honoring customer obligations, and complying with applicable laws.
3. Client responsibilities
Clients must provide accurate business, service-area, pricing, availability, phone, website, review, and customer communication details. Clients must review and approve messaging, automation behavior, phone/SMS settings, AI voice behavior, website changes, and other customer-facing setup before launch. Clients are responsible for service quality, customer claims, licenses, insurance, and legal/compliance obligations in their market.
4. Billing, renewal, and cancellation
Subscriptions renew monthly until canceled. Setup fees cover initial configuration work. Unless a client requests immediate shutdown and ProspectPull confirms it, cancellation stops future renewal and service continues through the current paid-through billing period while live phone, SMS, website, follow-up, review, or AI automation is safely offboarded. Third-party costs such as phone, SMS, carrier/A2P, AI voice minutes, payment processing, or unusual usage may be billed separately with notice.
5. Refunds and guarantee
If ProspectPull does not help a client capture, organize, or respond to leads more effectively within the first 30 days, the client may request a refund of the first monthly payment. Setup fees are refundable only if ProspectPull is unable to complete the agreed setup. Refund eligibility may be denied for abuse, inaccurate client information, lack of required access, or requested work outside the agreed scope.
6. Messaging, phone, and AI limitations
Messages, calls, automations, and notifications may be delayed, blocked, filtered, or fail due to carriers, platforms, internet outages, customer devices, third-party service issues, compliance reviews, or incorrect setup information. ProspectPull may pause or disable automations if required for safety, compliance, billing, deliverability, or platform-policy reasons.
7. Acceptable use
Clients may not use ProspectPull for spam, deceptive messaging, illegal services, harassment, sensitive personal data collection beyond the agreed use, misleading claims, fake reviews, review gating, emergency dispatch promises, or communications without proper consent.
8. Data and account access
ProspectPull may process client business data, lead data, setup information, support requests, and message/call metadata to provide the service. Clients are responsible for authorizing access to accounts, tools, websites, phone numbers, and third-party systems needed for setup and fulfillment.
9. Limitation of liability
To the maximum extent allowed by law, ProspectPull is not liable for indirect, incidental, special, consequential, punitive, lost-profit, lost-revenue, lost-lead, lost-data, or business-interruption damages. ProspectPull's total liability for claims related to the service is limited to the amount the client paid to ProspectPull in the three months before the event giving rise to the claim.
10. Governing law and changes
These terms are governed by the laws of New York, without regard to conflict-of-law rules. ProspectPull may update these terms as the service evolves. Continued use after updates means the client accepts the updated terms.
